If EMIG consents to the creation of a link to its webpages, EMIG will propose a suitable agreement. No link to EMIG's webpages may be set before this agreement is concluded. Under no circumstances may content of EMIG's webpages be presented as the proprietary content of third parties unless provided for in the agreement to be reached with EMIG. Hyperlinks
EMIG will only be responsible for direct and/or indirect references to webpages of third parties ("hyperlinks") under the conditions laid down in section 3, articles 8-11 TDG and article 5 MDStv. EMIG is responsible for its own content in accordance with article 8 paragraph 1 TDG and article 5 paragraph 1 MDStv. In its decision 312 O 85/98 of 12 May 1998 on liability for links, Hamburg Regional Court rules that the setting of a link could entail shared responsibility for the content of the linked page. According to Hamburg Regional Court, this shared responsibility can only be avoided by expressly distancing oneself from this content. Hyperlinks are only established with approval of the third party ensuring the copyright/identification rights of third parties. The same applies for contents of webpages of third parties, reproduced on EMIG webpages. EMIG expressly points out that no unlawful content was identifiable on the relevant webpages of third parties at the particular time a hyperlink for EMIG was established. Should EMIG become aware of unlawful content of third parties which can be accessed directly or indirectly from EMIG's webpages, EMIG will remove this unlawful content immediately and disable any means of access to it from EMIG's webpages. Should unlawful content not identified by EMIG subsequently exist on directly or indirectly linked webpages of third parties, EMIG hereby distances itself expressly from such content. Copyrights/identification rights
All copyrights and identification rights arising from EMIG's webpages and/or reproduced there remain with EMIG or the respective owner of the rights. You agree to indemnify, hold harmless and defend Google and its wholly owned subsidiaries, at Your expense, any and all third-party claims, actions, proceedings, and suits brought against Google or any of its officers, directors, employees, agents or affiliates, and all related liabilities, damages, settlements, penalties, fines, costs or expenses (including, without limitation, reasonable attorneys' fees and other litigation expenses) incurred by Google or any of its officers, directors, employees, agents or affiliates, arising out of or relating to (i) Your breach of any term or condition of this Agreement, (ii) Your use of the Service, (iii) Your violations of applicable laws, rules or regulations in connection with the Service, or (iv) Your Brand Features. We do not collect any personal details in connection with our website. Consequently we do not create any user profiles, either as personal data or under a pseudonym. Personal data in connection with the viewing of EMIG's website is thus also not collected and cannot be made accessible to third parties.
